A Susanville man, José Antonio Magallanes, 42, has been convicted and sentenced for violating a domestic violence restraining order and obstructing law enforcement. The charges stemmed from a June 2024 incident when Magallanes entered a home he was legally barred from accessing due to a court order.
When police and sheriff’s deputies arrived, Magallanes refused to leave, disputing the court order and delaying law enforcement efforts. His resistance wasted valuable resources that could have been used elsewhere in the community.
Following a jury trial, Magallanes was found guilty of violating Penal Code sections 273.6 and 148(a), both misdemeanors carrying a potential penalty of up to a year in county jail. The court sentenced him to 270 days, and he has already begun serving his sentence.
“We’re grateful to the jury for their time and careful deliberation,” said Deputy District Attorney Guy Manchuk, who prosecuted the case. This marks the 25th jury trial presented in Susanville this year, with the case submitted by the Susanville Police Department.
