A Modoc County judge has ruled there is enough evidence for a man accused of a violent domestic assault to stand trial on multiple felony charges.

Following a preliminary hearing, Judge Harr ordered Matthew Boldt to answer to charges including attempted murder, torture, sexual penetration by force, assault with a deadly weapon likely to produce great bodily injury, criminal threats, corporal injury to a spouse or cohabitant, and false imprisonment, according to the Modoc County District Attorney’s Office.

The court also found sufficient evidence to support several sentencing enhancements, including allegations that the victim suffered great bodily injury, that the injuries occurred during a domestic violence incident, that the victim was particularly vulnerable, and that the defendant used a weapon during the alleged crimes. The court further found evidence supporting allegations that Boldt abused a position of trust and engaged in violent conduct indicating a serious danger to society.

The judge did not hold Boldt to answer on a charge of mayhem, and declined to support special allegations involving interference with the judicial process and increasing seriousness of prior convictions.

Following the hearing, Boldt was remanded into custody without bail. He is scheduled to be arraigned on the information July 6, when he is expected to enter formal pleas to the charges.

In a statement, Modoc County District Attorney Nina Salarno said the court’s ruling confirms there is sufficient evidence for the case to move forward toward trial and reaffirmed the office’s commitment to seeking justice for the victim.

As with all criminal cases, the defendant is presumed innocent unless and until proven guilty in a court of law.
