After being scheduled for the beginning of the month and being delayed the Lassen Superior court will hear the demurrer plea by the State and the CA Dept of Corrections and Rehabilitation in the City of Susanville’s case fighting the announced closure of the California Correctional Center. The plea is CDCR and the State seeking dismissal of the case as they believe it is premature and that the city of Susanville has no case to stand on given proper review processes have begun. Yet traveling Judge Moody who has been presiding over the case suggests the opposite in that a ruling on the state’s demurrer is in fact “premature.” The court will hear the plea this Friday at 10am.
