This coming Tuesday a case management conference hearing will be held in the Lassen Superior courthouse in the continuance of the ongoing litigation between the City of Susanville against CDCR and the State for the announced closure of CCC in April of 2021. The hearing begins at 9 am. The state is seeking the removal of the injunction that was enacted by Lassen Superior Court Judge Nareau shortly after the initial closure date of CCC was announced. If removed CDCR would be able to move forward with closure procedures as the prison including inmate and staff transfers. A second hearing is also on the court calendar for August 12th for the renewed demurrer plea by CDCR who are asking for dismissal of the case based on the rewritten penal code that eliminates prison closure criteria. The same penal code the city has based its case on.
