The District Attorney has completed review of the case file submitted regarding the officer-involved shooting that occurred on May 6, 2026 and compiled a report detailing the findings.

Sikong posed an imminent and serious threat to the life of David Lee that needed to be instantly confronted, that there was no viable less-lethal alternative available to stop the threat, and therefore the discharge of his firearm on this occasion by David Lee was justified and not unlawful, and 4)
that the discharge of the less-lethal munition by KC Capron was an act of defense of others, or self-defense, and was justified and not unlawful.
Finally, the District Attorney considered the following:
That, despite being injured himself, requiring medical attention, Lee’s first course of action was to report shots fired and to request medical assistance. He then began to render life-saving measures to Sikong. Throughout review of his body worn camera, he was heard repeatedly to express concern about the well-being of the children. He remained calm with Sikong, reminded
him to breathe, inquired on the status of the medics, and continued taking turns performing chest compressions with Sheriff personnel arriving on scene. In reviewing any case, a witness’s demeanor or overall attitude about an incident is always relevant and it is of particular note that Lee appeared both on scene and during his investigative interview to be genuinely sad about the occurrence of events.
That Capron, upon entering the residence, immediately ascended upstairs to tend to the children. While contacting them, Capron remained calm, inquired as to the children’s well- being, and checked them for injuries. At one point in time, he pried a piece of glass out of the 2-year-old baby’s hand. He moved them to a separate room to keep them safe where they stayed under the careful watch of a deputy sheriff. When it came time to move the children out
of the home, Capron took steps to dress them. He carried the 2-year-old out and then returned for the 4-year-old, assisted by a sheriff sergeant taking the 8-year-old.
That all of the peace officers recognized the seriousness of what had occurred and displayed the respect for the sanctity of human life required upon them by Penal Code section 835a.
Conclusion
The death of Ngirasiau “Derek” Sikong was tragic, but the actions of the officers were not unlawful. There will be no criminal charges forthcoming against either David Lee or KC Capron for their involvement in this incident on May 6, 2026.
The Office of the District Attorney offers our condolences to the family of Derek Sikong and will continue to provide support and resources for the children involved in this incident through our Child Advocacy Center as needed.
The District Attorney recognizes the toll this incident has taken on all parties– certainly the friends and family of Derek Sikong, all of the officers, and even the community in general. The District Attorney further recognizes there is an understandable public concern and a high level of interest
in all of the circumstances that led to this event. In writing this, the goal was to ensure that the relevant facts relating to the review of this matter were conveyed in a manner that was both cognizant of the need for transparency, but also sensitive to all of the parties. This document will be made publicly available.
