DEFENDANTS REMANDED WITHOUT BAIL IN SIGNIFICANT NARCOTICS TRAFFICKING CASE

Modoc County District Attorney Nina Salarno announced that defendants Tracy Tavernetti and Dennis Marcott appeared before the Honorable Judge Harr in Modoc County Superior Court and formally waived their Preliminary Hearing
after being charged with multiple felony narcotics-related offenses. Defense counsel argued for release. Applying the most recent Kowalczyk and Humphrey case law the Honorable Judge Harr ordered both defendants remanded into custody without bail, recognizing the serious threat to public safety posed by the allegations in this case.
The defendants are charged with multiple felony offenses involving the transportation, sales, and possession of controlled substances for purposes of distribution, conspiracyrelated allegations, and unlawful firearm possession. Additional misdemeanor allegations involve narcotics possession and drug paraphernalia offenses.
A subsequent Motion for Reconsideration was argued before the Court today. Following further argument and review, Judge Harr again properly applied the standards set forth under Kowalczyk and Humphrey and denied the motion, ordering that Ms. Tavernetti remain remanded in custody.
District Attorney Nina Salarno stated: “The Modoc County District Attorney’s Office remains committed to aggressively prosecuting individuals involved in the trafficking and distribution of dangerous controlled substances within our communities. The Court’s decision to remand these defendants without bail reflects the serious public safety
concerns associated with these allegations.”
The case remains under active prosecution. All defendants are presumed innocent unless and until proven guilty in a court of law.
The Modoc County District Attorney’s Office extends its appreciation to the law enforcement agencies and investigators involved in this case for their continued efforts in combating narcotics trafficking and protecting the residents of Modoc County.
