MODOC COUNTY SUPERIOR COURT SHOWS LENIENCY TO FELONY EVADING AND REPEAT DUI OFFENDER.

Modoc County District Attorney, Nina Salarna issued the following press release –

It is both my sworn duty as your elected District Attorney and for the community of Modoc to inform you of certain criminal case outcomes which I believe result in serious public safety ramifications. Although I must respect the decisions of the Court, I must disagree with them when my ethical and legal responsibilities require me to and also represent those concerns to the community who has the right to know. A recent case presided over by Judge Wendy Dier demonstrates my concern as such. On Tuesday, December 2, 2025, Javier Adrian Walker was sentenced after being convicted of felony evading a peace officer after refusing to stop his vehicle
and felony driving under the influence of alcohol with three or more prior “DUI”” convictions. Further, Walker was also on probation for two recent DUI convictions from just last year. Walker also has DUI convictions in Nevada (2018) and in Oregon (2021). Demonstrating his own inability to control his substance abuse, Walker’s current arrest occurred just one month after completing court ordered substance abuse treatment for his prior DUIS. Recognizing Walker’s ongoing dangerous threat to the public, the Probation Department recommended that Walker be sentenced to prison for two years and eight months while I argued for the upper term of three years and eight months. During sentencing the victim in this most recent case delivered an impact statement
expressing fear of him. Judge Wendy Dier’s sentence? Give Walker another chance by giving him more
probation with county jail time instead of prison so as to continue his treatment under more conducive circumstances. I vehemently objected to Judge Dier’s sentence by stressing that Walker is obviously incapable of rehabilitation and that it is foreseeable that he will continue to drive while intoxicated and eventually injure or kill someone. Judge Dier was unmoved by my advocating for sentencing reconsideration. As always, I am available to you for any concerns and questions.
