Commission on Judicial Performance Moves Forward with Complaints Against Lassen County Judge Mallery

The Commission on Judicial Performance has completed its preliminary investigation of Lassen County Superior Court Judge Tony Mallery, the former presiding judge, on charges of judicial misconduct.

Based on the findings, the commission will move forward with formal proceedings to inquire into charges made against Mallery. Those allegations state that Mallery acted in a way that was contrary to the principles of fairness, impartiality, and integrity that are essential to the administration of justice and that his actions undermined public trust in the judicial system. This type of conduct is considered “improper action” under Article VI, section 18 of the California Constitution, which allows for the judge’s removal, censure, or public or private admonishment for engaging in this behavior.

Judge Mallery is required to provide an answer by today. According to the rules of the court, no further pleadings shall be filed, and no motion or demurrer shall be filed against any of the pleadings.
