Final oral arguments were heard on Thursday regarding the conduct of Lassen Superior Court Judge Tony Mallery before the Commission on Judicial Performance in San Francisco.
Mallery’s representation sought to persuade the Commission to offer the Judge retirement rather than force his removal from the bench. The Special Masters Findings of Fact and Conclusions of Law report concluded Mallery committed multiple counts of misconduct, noting his failure to take responsibility for his actions, which included disregarding court schedules, mistreating staff, and displaying imperious behavior towards attorneys. The report concludes that Judge Mallery’s lack of self-awareness and failure to acknowledge his responsibility only aggravated the disciplinary matter.
Thus, the examiner’s recommendation for his removal.
Per the Director Chief Council of the CJP, the commission is expected to issue a decision within 60 days.
