SOMETHONIT PHOUMYCHACK, 37, of Reno NV was found guilty by a jury on December 11, 2025, of driving under the influence of alcohol and driving with a blood alcohol content of .08% or more. The jury also found true special allegations that Phoumychack refused to submit to a chemical test and had an elevated blood alcohol content of over .20%.
A concerned citizen reported Phoumychack to 911 after observing him at Hallelujah Junction. A CHP officer from Quincy responded and observed Phoumychack to be exhibiting objective signs of alcohol consumption. Phoumychack refused to participate in any field sobriety tests and refused to submit to a chemical test. A search warrant for a blood sample was obtained. The blood sample yielded an alcohol content of .25%.
On December 22, 2025, in a separate proceeding, Phoumychack admitted to having sustained two prior convictions for DUI in 2016 and 2018. Sentencing will be scheduled for a date in January. There is a statutory minimum jail time required of 120 days for a third DUI, a maximum of up to one year.
This year our office filed 145 DUI cases. That is an average of one DUI driver every 2.5 days. This holiday season, please don’t be the reason you or someone else doesn’t make it home because of drinking and driving.
This case was submitted by Quincy CHP and prosecuted by DDA Guy Manchuk. We thank the jury for their time and attention in this matter.
